Former Executive of a Listed Software Group
We represent a former executive of a publicly listed software group in high-value wrongful dismissal proceedings before the Luxembourg Labour Court. Our client held a dual capacity as both corporate officer and employee, with the Luxembourg subsidiary acting as his employer.
The dismissal occurred in circumstances that our client contends were both procedurally irregular and substantively unjustified, giving rise to significant legal, financial and reputational consequences. The matter is particularly complex as it sits at the intersection of employment law, corporate governance and executive remuneration.
Our team developed and implemented the overall litigation strategy. Our claims seek, first, recognition that the dismissal was wrongful, together with confirmation of our client’s good leaver status and entitlement to the full financial benefits attached to that status. Secondly, we seek substantial compensation for the material and moral damage suffered as a result of the dismissal, reflecting its significant impact on our client’s career, remuneration and professional reputation.
The mandate extends beyond the employment proceedings. We have initiated bank account seizure proceedings against the employer and are coordinating closely with a leading Paris law firm in relation to issues falling within the jurisdiction of the French courts, notably concerning our client’s entitlement under a long-term Management Incentive Plan.
The matter demonstrates the firm’s ability to handle highly sensitive disputes involving senior executives with dual employee and corporate officer status, combining employment litigation, corporate governance issues and cross-border coordination in a matter of considerable financial and strategic importance.
