Contemporary Challenges in Banking and Finance Law: “Data Security and Protection Are Essential”
Interview with Anne-Marie Ka, Partner at Brucher Thieltgen & Partners
Anne-Marie Ka was admitted to the Bar in 2009, the same year she joined Brucher Thieltgen & Partners. Today, she is a key member of the firm’s Banking and Finance practice, advising clients on transactional, regulatory and litigation matters. In this interview, she discusses how financial institutions are adapting to regulatory developments.
The banking sector is at a decisive turning point in 2025. What regulatory pressures is it facing?
Since 2008, we have indeed witnessed a significant increase in regulation covering sensitive areas such as fraud and cyberattack prevention, sustainable finance, digital assets and investor protection. Some legislation is adopted at the European level, and it is not uncommon for these rules to be outdated by the time they are transposed into national law. I am thinking particularly of regulations concerning new technologies and artificial intelligence.
Other pressing issues include sustainable finance, digital assets and the challenges associated with instant payments.
How can financial institutions adapt to a constantly changing environment while maintaining client trust?
Communication is essential! Financial sector professionals who are aware of upcoming regulatory developments, particularly those under discussion at the European level, must anticipate changes and prepare their clients by sharing their knowledge and expertise.
It is equally important to anticipate the operational implementation of these new regulations. Our role is not only to inform our clients but also to reassure them.
How do you guide your clients through this increasingly complex regulatory framework?
We have developed a range of tools for our key clients, including legal monitoring services covering topics of particular interest to them, with the possibility of receiving summaries of the main points whenever significant new regulations are introduced.
We also offer the possibility of organising series of conferences on specific topics that may be of interest to our clients’ legal departments.
Finally, some of our clients benefit from priority telephone access to our teams, allowing us to address their questions regarding the practical implementation of new regulations.
The digitalisation of financial services makes the adoption of new technologies essential. What challenges are financial institutions currently facing?
The first essential consideration is data security and protection. Risk management is equally crucial: it is important to establish procedures that enable organisations to respond quickly to potential issues.
Financial institutions must also stay up to date and remain adaptable.
Finally, given the challenges posed by new technologies, it is essential to ensure that employees receive appropriate training on these new procedural requirements.
